Welcome to VortexVista ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the VortexVista weather forecasting services, including our website, mobile applications, and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access the Service.

2. Service Description

VortexVista is a weather forecasting platform that provides:

• Current weather conditions and forecasts
• Hourly, daily, and extended weather predictions
• Severe weather alerts and notifications
• Historical weather data and analytics
• Weather-related news and educational content

We source our weather data from various meteorological providers and process it through our proprietary forecasting algorithms.

2.1 Service Limitations

While we strive for accuracy, weather forecasting is inherently uncertain. VortexVista does not guarantee:

• The accuracy, completeness, or reliability of any weather information
• That the Service will be available uninterrupted or error-free
• That any defects will be corrected

3. User Accounts

3.1 Account Creation

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY WEATHER INFORMATION

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VORTEXVISTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
• ANY DECISIONS MADE BASED ON WEATHER INFORMATION PROVIDED BY THE SERVICE

IN NO EVENT SHALL VORTEXVISTA'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID VORTEXVISTA, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless VortexVista and its licensors, suppliers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any decisions or actions taken based on information obtained from the Service

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

If you do not agree to the modified Terms, you must discontinue using the Service.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
